98.5 The OCEAN Girls Night Out Lady Gaga CONTEST RULES

ROGERS BROADCASTING LIMITED

1.       (a) “Contest Period” starts at 12:01 a.m. on Monday, July 19th, 2010, up until 11:59pm on Sunday August 1st 2010, the “Contest Closing Date”, to enter go to www.ocean985.com and sign up to the VIP Platinum Club for free via link and fully complete the sign up information, redeem 1000 Points and submit by the Contest Closing Date, if you are already a member of VIP Platinum Club, log onto your account and redeem 1000 Points and submit by the Contest Closing Date.  All times are Pacific Times.

No purchase, expenditure or investment is necessary to enter this Contest. To enter this Contest without redeeming 1000 Points online, hand print your name, address, day and evening phone numbers, email address, age, and a hand written 100 word essay explaining why you would like to win 98.5 The OCEAN’S Destination Nanaimo Getaway from 98.5 The OCEAN and mail it to “98.5 The OCEAN’S Destination Nanaimo Getaway”, 817 Fort Street, Victoria, BC, V8W 1H6 to be received before the Contest Closing Date. You will receive one (1) entry into the Contest during the entry period for which your request was postmarked and received, to be postmarked by the Contest Closing Date. Limit of one (1) mail-in request per postage stamped envelope per day.

(b) A random draw by a Rogers Broadcasting Limited (“Rogers”)  representative, as represented by 98.5 The OCEAN (“98.5 The OCEAN”) will be made on Monday, August 1st, 2010 from all eligible entries received as of the Contest Closing Date, at the Rogers office - 817 Fort Street, Victoria, BC, V8W 1H6. The selected entrant will be contacted by phone or email at the number or email address listed on their entry form/mail in entry.
(c) If a selected entrant cannot be reached by Sunday, August 8th , 2010, incorrectly answers the skill testing question, or declines the prize, or fails to return the signed release and acknowledgment as indicated below, another entrant will be randomly drawn on Monday August 9th, 2010
 (d) You may enter as often as you wish provided you redeem 1000 Points for each entry.  If the identity of an entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s).

(e) Participants will be eligible to win one (1) Grand Prize, having an approximate retail value of $2500 and consisting of 98.5 The OCEAN’s Girls Night out to Lady Gaga:

- Return airfare for 4 people seated in economy section on the Helijet leaving from Victoria  Tuesday August 24th and returning Wednesday August 25th.

- 1 night/1 room accommodation for 4 people at the Downtown Victoria Marriott Pinnacle

- 4 tickets for the Rogers Broadcasting Private Box at Rogers Place on August 24th to watch the Lady Gaga Concert..

 

The grand prize has no cash value. Any costs associated with the redeeming of the prize are the responsibility of the winner.

 

(f)Winner and travel companion are solely responsible for ground transportation, taxes, transfers, travel insurance, spending money, tips, meals and other travel and hotel charges not specifically mentioned as part of the prize.  Winner and travel companion are solely responsible for obtaining their own travel documents such as passport in advance of the departure date.  Rogers is not responsible in the event winner and/or travel companion are refused entry to New York or re-entry to Canada for whatever reason and any unused portion of the prize will be forfeit.  In the event the companion is a minor, the companion’s parent or legal guardian must sign the release and declaration of liability on behalf of the minor if the adult winner is not the parent or legal guardian of the minor, the parent or legal guardian must consent to the designated accompanying adult in taking part in the Grand prize.  Winner and traveling companion must travel together on the same itinerary. 

 

(g)Winner must be able to depart on August 24th and return on August 25th, 2010. Trip must be taken on dates specified by Rogers.  In the event winner and/or guests cannot travel within the dates specified by Rogers or are unable to attend a selected event for whatever reason, any unused portion of the prize will be forfeited. All travel arrangements and bookings will be arranged by Rogers or its agents. No responsibility is assumed by Rogers for any other factor beyond its reasonable control, or for a cancelled, delayed, or re-scheduled event for any reason whatsoever.

 

(h)Due to the nature of the Grand Prize, no alternative dates are available other than those selected by Rogers. 

 

2.       Rogers reserves the right to substitute a prize of at least equal or greater value in the event of unavailability of the advertised prize.

3.       (a) In order to win, selected entrant must first correctly answer, unaided, a time limited, mathematical skill testing question, posed by telephone at a mutually convenient time.

(b) Rogers judges' rulings are final and without appeal in all matters related to the Contest and the awarding of prizes.

4.       Selected entrant will be required to return a signed release and acknowledgment form before being declared a winner. The traveling companion must also return a signed release and acknowledgment before being ticketed, once ticketed no changes are permitted.

5.       By entering this Contest, each entrant consents to the use of her entry, name, address, voice and/or photograph in any publicity carried out by Rogers and its advertising agencies, without further compensation. Winner consents to his/her photograph being taken by Rogers for such use, without further compensation. All entries become the property of Rogers.

6.       This Contest is open to all residents of southern Vancouver Island (Duncan and south) in B.C., 19 years of age and older as of the date of entry, except employees of Rogers, its parent and affiliate companies; its representatives and agents, the Contest suppliers, any persons residing in their respective households [1] and any immediate family members [2].  The Contest is subject to all applicable federal, provincial and municipal laws and regulations.

7.       No correspondence will be entered into except with the selected entrant.

8.       Chances of winning depend on the number of eligible entries received. Rogers is unaware of how many entrants there may be. The winner may come from any geographic area, so long as they otherwise qualify to enter this Contest.

9.       All entries which are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Rogers. Rogers takes no responsibility for lost, misdirected, late or destroyed entries, or for typographical or other production errors.

10.   All entries become property of Rogers who assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for failure of the Internet or Rogers network during this Contest period, for any problems or technical malfunction of any telephone network or lines, cell sites, microwave dish, antenna, switch, computer on-line systems, servers, access providers, computer equipment, software, failure of any communication or traffic congestion on the Rogers or other network, or any combination thereof including any injury or damage to an entrant's or any other person's wireless device or personal computer related to or resulting from playing or downloading or sending any material in this Contest. Rogers reserves the right, in its sole discretion, to cancel or suspend the online or email portion of this Contest should a virus, bug or other cause beyond the reasonable control of Rogers corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any equipment or system or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Rogers reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

11.   Rogers is collecting personal data about entrants for the sole purpose of administering this Contest. No further informational or marketing communications will be received by the entrant unless the entrant provides Rogers with explicit permission to do so at the time of entry. 12.   This Contest will be run in accordance with these rules, subject to amendment by Rogers. Entrants must comply with these rules, and will be deemed to have received and understood the rules if they participate in the Contest.

13.   The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
